Spam (unsolicited email) is the use of electronic messaging systems to send unsolicited bulk messages, especially advertising, indiscriminately. While the most widely recognized form of spam is e-mail spam, the term is applied to similar abuses in other media such text messaging. Something important to remember is that phishing and spoofing is popular on the Internet especially for spammers who try and retrieve your banking username and password details. Your bank will never send an unsolicited message to you requesting you to change your password. Always check the senders address and if you are unsure, verify this message by phoning your bank and reporting this directly to them.

The Electronic Communications and Transactions Act of 2002 provides for the facilitation and regulation of electronic communications and transactions; to provide for the development of a national e-strategy for the Republic of South Africa and protects consumers from receiving unsolicited email.

Unsolicited goods, services or communications

45. (1) Any person who sends unsolicited commercial communications to consumers, must provide the consumer—­

  • with the option to cancel his or her subscription to the mailing list of that person; and
  • with the identifying particulars of the source from which that person obtained the consumer's personal information, on request of the consumer.

(2) No agreement is concluded where a consumer has failed to respond to an unsolicited communication.
(3) Any person who fails to comply with or contravenes subsection (1) is guilty of an offence and liable, on conviction, to the penalties prescribed in section 89(1).
(4) Any person who sends unsolicited commercial communications to a person who has advised the sender that such communications are unwelcome, is guilty of an offence and liable, on conviction, to the penalties prescribed in section 89(1).
